Every person who uses the Web Shop and/or makes use of our services (hereinafter the "Data Subject", "you" and "your") will almost inevitably provide certain personal data. This personal data constitutes information that enables us to identify you as a natural person, regardless of whether we actually do so. You are identifiable as soon as it is possible to establish a direct or indirect link between one or more personal data and you as a natural person.

We promise to use and process your personal data only in accordance with the GDPR and any replacement legislation, or any similar regulation under any applicable law and any legal requirements or codes of conduct relating to the use, storage or transfer of personal data. Any reference in this Privacy Statement to the 'GDPR' is a reference to the Regulation of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation).

Through this Privacy Statement, every Data Subject is informed of the processing activities that KLIUM may carry out with their personal data. KLIUM reserves the right to amend this Privacy Statement at any time. Any substantial change will be clearly communicated to the Data Subject. We recommend that you consult this document regularly.

2. Who processes your personal data?

2.1 Controller

KLIUM is responsible for the processing of your personal data and determines, alone or in collaboration with others, which personal data are collected, as well as the purpose and means for processing this personal data. KLIUM is therefore the 'controller' within the meaning of the GDPR.

2.2 Processor(s)

KLIUM is free to engage data processors. A processor is a natural or legal person who processes personal data at the request of or on behalf of the controller. The processor is obliged to ensure the security and confidentiality of the personal data. The processor always acts in accordance with the instructions of the controller.

KLIUM engages the following categories of "processors":

  • Companies engaged for marketing purposes (e.g. Google, Meta, Microsoft);
  • Companies engaged for communication and customer service purposes (e.g. Zendesk);
  • Companies engaged for payment purposes;
  • Companies engaged for distribution & logistics;
  • Companies engaged for website optimisation and analytics (e.g. Google Analytics, Microsoft Clarity, Baqend, Emarsys);
  • Companies engaged for cookie consent management (Cookiebot);
  • Companies engaged for customer reviews (Kiyoh).

3. On what legal basis is your personal data processed?

In accordance with the GDPR, we process personal data on the basis of the following legal grounds:

  • On the basis of the performance of the agreement as agreed with the Data Subject; or
  • On the basis of compliance with legal or regulatory provisions relating to the management of the contractual relationship, in particular invoicing, or the performance of pre-contractual steps taken at their request;
  • On the basis of our legitimate interest in sending information and newsletters to our existing customers about similar products;
  • On the basis of your explicit consent to send promotional offers (direct marketing) and to place marketing and advertising cookies.

4. What personal data is processed?

KLIUM undertakes to collect and process only those personal data that are relevant and necessary for the purposes for which they are processed. The following categories of personal data are processed:

  • Personal identification data (name, surname, address, login credentials);
  • Contact details (telephone number and e-mail address);
  • Financial identification data (banking details);
  • Electronic identification data (IP address, cookies, browsing behaviour);
  • Business data (company name and VAT number, for B2B customers).

This personal data is collected when you register on the Web Shop and/or make use of our services. Other personal data may be collected at a later stage, for example in the context of our after-sales service. The amount of personal data collected depends on your use of the Web Shop and our services.

We also use cookies to recognise visitors and users of our Web Shop and to offer a personalised user experience, to remember their technical choices (for example a language or a "shopping basket") and to detect and correct any errors on the Web Shop. Please consult our Cookie Policy for more information on the way we use cookies.

In practice this means: Klium processes your personal data in the context of its activities. This includes:

  • Category 1, based on cookies: your IP address and details of your visit to our Web Shop including browsing behaviour, origin and search terms
  • Category 2, upon registration or via one of the forms on our Web Shop: your name and surname, possibly the name of your company and VAT number, address details, your e-mail and any other data you provide in the free text field
  • Category 3, if you call or e-mail us: your e-mail address and/or telephone number, as well as the data you disclose yourself
  • Category 4, upon subscription to our newsletter: your e-mail address
  • Category 5, when placing an order: your name and surname, possibly the name of your company and VAT number, address details and your e-mail.

5. For what purposes is your personal data used?

KLIUM collects your personal data in order to offer every visitor and user of our Web Shop a safe, optimal and personalised user experience. The collection of personal data increases as the Data Subject makes more intensive use of our Web Shop and our online services. KLIUM reserves the right to suspend or cancel certain operations if personal data is missing, incorrect or incomplete.

Data processing is essential for the operation of our Web Shop and for our service delivery. KLIUM undertakes to process your personal data exclusively for the following specific purposes:

  • The handling and processing of information requests, product orders and purchases;
  • Centralised customer management;
  • The distribution of information and newsletters that are useful and necessary for the Data Subject;
  • The prevention of irregularities and combating abuse and criminal behaviour;
  • The handling of complaints;
  • Ensuring the proper functioning of our Web Shop, including the use of cookies, local storage information, information about the hardware and software used and log information such as the IP address and telecommunication data;
  • Personalised marketing and advertising if you have explicitly consented to this. In that case, you are free to withdraw your consent at any time.

When visiting the Web Shop, some data is collected for statistical purposes. Such data is necessary to optimise the use of our Web Shop. This data includes: IP address, probable location of consultation, time and day of consultation, which pages were visited. By visiting the Web Shop, you agree to this data collection for statistical purposes as described above.

The Data Subject always provides personal data to KLIUM themselves and can thus exercise a certain degree of control. If certain personal data is incomplete or apparently incorrect, KLIUM reserves the right to temporarily or permanently postpone certain expected operations.

In practice this means

  • Category 1: Maintaining and improving our Web Shop and marketing activities and incorporating Personal Data in anonymous statistics, on the basis of your explicit, prior consent upon your first visit to our Web Shop
  • Categories 2 and 3: Answering questions and information requests, on the basis of the performance of a service you have requested
  • Categories 2, 3 and 4: Direct marketing, newsletters, campaigns and promotions by Klium itself, on the basis of our legitimate interest with regard to existing customers or your explicit, prior consent if you are not yet a customer at Klium. You can at any time indicate that you no longer wish to receive our newsletters via the opt-out option in our newsletters or by contacting us directly by e-mail or telephone
  • Category 5: The delivery and invoicing of products or services ordered by you, on the basis of the performance of an agreement you have requested and for which the processing of your Personal Data is necessary, or because the law requires it, or because Klium has a legitimate interest in doing so.

6. Who receives your personal data?

Your personal data is processed primarily internally by KLIUM. However, we engage carefully selected third parties (processors and controllers) who have access to certain personal data in the context of their services. These fall into the following categories:

  • Companies engaged for marketing purposes (e.g. Google, Meta/Facebook, Microsoft/Bing);
  • Companies engaged for communication and customer service purposes (e.g. Zendesk);
  • Companies engaged for payment purposes;
  • Companies engaged for distribution & logistics;
  • Companies engaged for website optimisation and analytics (e.g. Google Analytics, Microsoft Clarity, Baqend, Emarsys/Scarab Research);
  • Companies engaged for cookie consent management (Cookiebot);
  • Companies engaged for customer reviews (Kiyoh).

Your personal data will never be sold to third parties.

6bis. International transfer of personal data

Certain third parties with whom KLIUM collaborates are established outside the European Economic Area (EEA) or process data on servers outside the EEA — in particular in the United States. A transfer to third countries is only permitted when one of the following conditions is met:

  • The receiving country has an adequacy decision from the European Commission;
  • Appropriate safeguards have been put in place, such as Standard Contractual Clauses (SCCs) approved by the European Commission;
  • The Data Subject has given explicit consent to the transfer.

For all third parties outside the EEA, KLIUM uses Standard Contractual Clauses (SCCs) as the legal basis. A full overview per provider is included in the table in section 3 of the Cookie Policy below.

7. How long do we retain your personal data?

Your personal data is retained for as long as necessary to achieve the purposes set out in article 5. It is deleted from the database when it is no longer needed to pursue these purposes or if the Data Subject validly exercises the right to erasure of personal data.

  • Customer profile: if you do not place an order for 5 years, we will delete your customer profile
  • Invoice data: we are required by law to retain your invoice data for at least 7 years from the calendar year following the last invoice date
  • Newsletters: if you are an existing customer, we retain your data for newsletters until 3 years after your last order. If you are not an existing customer and have given consent for newsletters, we retain your data until you have withdrawn your consent
  • Cookies: the specific retention period per cookie is included in the cookie tables in the Cookie Policy below

8. What are your rights?

8.1 Guarantee of lawful and secure processing of personal data

Your personal data is always processed for legitimate purposes, as set out in article 5. It is collected and processed in an appropriate, relevant and proportionate manner, and is not retained longer than necessary to achieve the stated purposes.

KLIUM has taken appropriate technical and organisational security measures to guarantee you secure processing of personal data. These security measures are proportionate to the nature of the personal data and the potential risks.

The risks of accidental or unauthorised destruction, accidental loss, alteration or access to, and any other unauthorised processing are thus reduced to a minimum.

8.2 Right of access

If you can prove your identity, you obtain the right to receive information about the processing of your personal data. You therefore have the right to access the purposes of the processing, the categories of personal data, the categories of recipients to whom the personal data is sent, the criteria that determine the data retention period and the rights you can exercise with regard to your personal data.

8.3 Right to rectification of personal data

Inaccurate or incomplete information can be corrected. It is primarily the responsibility of the Data Subject to make the necessary changes to their "User Profile". You may also contact us with a request for amendment.

8.4 Right to erasure of your personal data

You also have the right to obtain the erasure of your personal data, in the following cases:

  • Your personal data is no longer necessary for the stated purpose;
  • You withdraw your consent to the processing of your personal data and there is no other legal basis for processing your personal data;
  • You have legitimately objected to the processing of your personal data;
  • Your personal data is being processed unlawfully;
  • Your personal data must be erased on the basis of a legal obligation.

The erasure of personal data is primarily related to visibility; it is possible that the deleted personal data may be temporarily stored.

8.5 Right to restriction of processing

In certain cases, you have the right to request restrictions on the processing of your personal data. This applies in particular in the event of a dispute regarding the accuracy of personal data, if the personal data is necessary in the context of legal proceedings, or during the time necessary for KLIUM to determine whether you can validly exercise your right to erasure.

8.6 Right to object

You have the right to object at any time to the processing of your personal data for direct marketing purposes. KLIUM will cease processing your personal data unless KLIUM can demonstrate compelling legitimate grounds for the processing which override your right to object.

The Data Subject is also entitled at any time, free of charge and without justification, to obtain the deletion of or a prohibition on the use of all personal data concerning them which, in view of the purpose of the processing, is incomplete or irrelevant, or whose registration, communication or storage is prohibited, or which has been retained beyond the permitted period.

8.7 Right to data portability

You have the right to receive the personal data you have provided to KLIUM in a structured, commonly used and machine-readable format. You also have the right to transfer this personal data to another controller, unless this is technically impossible.

8.8 Right to withdraw your consent

You have the right to withdraw your consent at any time, for example when you have given it for direct marketing purposes or for the placement of non-essential cookies.

9. How can you exercise your rights?

If you wish to exercise your rights, you must send a written request and proof of identity by registered letter to KLIUM, Ekkelgaarden 26 B-3500 Hasselt, Belgium or by e-mail to [email protected]. We will respond as soon as possible, and no later than one (1) month after receiving your request.

10. Possibility to lodge a complaint

Cookies

A cookie is a small text file placed on the hard drive of your computer or mobile device when you visit a website.
